Una dintre acestea, care ne dorim s\u0103 fie obiectul acestui articol, este posibilitatea de sistare a activit\u0103\u021bii prin declararea \u0219omajului tehnic.<\/p>\n<p>Conform art. 80 din CM,<br \/>\n(1) <strong>\u015eomajul tehnic<\/strong> reprezint\u0103 imposibilitatea temporar\u0103 a continu\u0103rii activit\u0103\u0163ii de produc\u0163ie de c\u0103tre unitate sau de c\u0103tre o subdiviziune interioar\u0103 a acesteia pentru motive economice obiective.<br \/>\n(2) Durata \u015fomajului tehnic nu poate dep\u0103\u015fi 4 luni \u00een decursul unui an calendaristic.<br \/>\n(3) Pe durata \u015fomajului tehnic, salaria\u0163ii se vor afla la dispozi\u0163ia angajatorului, acesta av\u00eend oric\u00eend posibilitatea s\u0103 dispun\u0103 reluarea activit\u0103\u0163ii.<\/p>\n<p>(4) \u00cen perioada \u015fomajului tehnic, salaria\u0163ii beneficiaz\u0103 lunar de o indemniza\u0163ie ce nu poate fi mai mic\u0103 de 50 la sut\u0103 din salariul lor de baz\u0103, cu excep\u0163ia cazurilor de suspendare a contractului individual de munc\u0103 conform art.77 lit. c).<br \/>\n(5) Modul \u00een care salaria\u0163ii vor executa obliga\u0163ia de a se afla la dispozi\u0163ia angajatorului, precum \u015fi m\u0103rimea concret\u0103 a indemniza\u0163iei de care beneficiaz\u0103 salaria\u0163ii \u00een perioada \u015fomajului tehnic, se stabilesc prin ordinul (dispozi\u0163ia, decizia, hot\u0103r\u00eerea) angajatorului, de contractul colectiv de munc\u0103 \u015fi de conven\u0163iile colective.<\/p>\n<p>\u00cen condi\u021biile \u00een care foarte pu\u021bine unit\u0103\u021bi economice au contract colectiv de munc\u0103, \u00een care ar fi descrise detaliile privind \u0219omajul tehnic, solu\u021bia optima ar fi emiterea unui ordin \/ dispozi\u021bii \/ decizii, etc. ale angajatorului.<\/p>\n<p>V\u0103 propunem un model de ordin, prevederile c\u0103ruia desigur trebuie ajustate la particularit\u0103\u021bile fiec\u0103rei unit\u0103\u021bi, astfel \u00eenc\u00eet s\u0103 r\u0103spund\u0103 modalit\u0103\u021bii de ac\u021bionare pentru angaja\u021bi afla\u021bi \u00een diferite situa\u021bii (concedii de odihn\u0103, sociale), descrie modalitatea de aducere la cuno\u0219tin\u021b\u0103 angaja\u021bilor, sursa de plat\u0103 a indemniza\u021biilor, m\u0103rimea acesteia, responsabilit\u0103\u021bile departamentului contabil, a managementului, angaja\u021bilor, etc.<\/p>\n<p><strong>PROIECT <\/strong><strong>\u00a0<\/strong><\/p>\n<p><strong>ORDIN \u2116 <\/strong><strong>_____ -k<\/strong><\/p>\n<p><strong>Cu privire la <\/strong><strong>anun\u0163area \u015fomajului tehnic<\/strong><\/p>\n<p><em>19 martie 2020\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0mun.
